General Terms and Conditions

1. Introduction

1.1 These General Terms and Conditions (hereinafter referred to as "GTC") govern the rights and obligations between the seller and the buyer arising in connection with the conclusion of purchase agreements through the online store available at the website:

1.3 The buyer is a consumer within the meaning of Section 419 of Act No. 89/2012 Coll., the Civil Code.

1.4 These GTC are an integral part of every purchase agreement concluded through the e-shop.

1.5 The costs of using remote communication means do not differ from the basic rate (the Seller does not charge any special fees).

 

2. Assortment and Legal Framework

2.1 The Seller primarily sells:

  • nicotine pouches,
  • chewing tobacco,
  • electronic cigarettes and their accessories.

2.2 The goods sold fall into the category of tobacco and nicotine products according to the valid legal regulations of the Czech Republic.

2.3 Nicotine is an addictive substance. The products sold are not intended for non-smokers, pregnant and breastfeeding women, or individuals sensitive to nicotine.

2.4 The Seller does not provide health, medical, or therapeutic recommendations.

2.5 Product photos on the website are for illustrative purposes only and may not correspond to the actual appearance of the product.

 

3. Age Restriction and Age Verification (18+)

3.1 The sale of all goods is exclusively for individuals over 18 years of age.

3.2 The buyer confirms compliance with the age limit:

  • upon entering the website,
  • when placing an order,
  • upon receipt of the shipment.

3.3 Age verification takes place:

  • electronically via the Adulto service,
  • by physical inspection of an identity document upon delivery of the shipment.

3.4 If the buyer's age cannot be verified, the Seller is entitled to refuse or cancel the order or not hand over the shipment.

3.5 The Seller is not responsible for false information provided by the buyer.

 

4. Order and Conclusion of the Purchase Agreement

4.1 The purchase agreement is concluded by the buyer sending an order and its confirmation by the Seller.

4.2 The Seller reserves the right to refuse an order, especially in case of doubts about the buyer's age, a technical error, an obvious error in the price, or unavailability of goods.

4.3 The buyer is obliged to provide true, complete, and current data.

 

5. Price and Payment Terms

5.1 All prices include VAT and all taxes, including any excise duty according to applicable legislation.

5.2 Payment methods:

  • bank transfer,
  • cash on delivery,
  • other methods according to the current e-shop offer.

5.3 The Seller reserves the right to unilaterally adjust the offer of payment methods.

5.4 In the event of an obvious error in the price of the goods or a technical error in the system, the Seller is not obliged to deliver the goods at the incorrect price and is entitled to withdraw from the purchase agreement.

 

6. Shipping and Delivery of Goods

6.1 Goods are delivered through contracted carriers.

6.2 Estimated delivery time is indicated for individual products.

6.3 Upon receipt of the shipment, the buyer is obliged to prove identity and allow age verification.

6.4 In case of refusal of age verification, the carrier is entitled not to hand over the shipment.

6.5 Ownership of the goods and the risk of damage pass to the buyer at the moment of receipt of the goods.

6.6 Costs associated with redelivery or return of a shipment due to a reason on the buyer's part are borne by the buyer.

6.7 In the event that the Seller does not deliver the goods even within an additional reasonable period, the buyer is entitled to withdraw from the contract.

 

7. Withdrawal from the Contract

7.1 The buyer has the right to withdraw from the contract within 14 days of receipt of the goods.

7.2 The right of withdrawal does not apply to goods that have been opened after delivery and cannot be returned for hygienic or health reasons, especially tobacco and nicotine products.

7.3 For withdrawal, the buyer may use the sample form available on the Seller's website.

7.4 The Seller will return the funds to the buyer no later than 14 days from the withdrawal, in the same manner as they were received, but not before receiving the returned goods.

 

8. Complaints and Liability for Defects

8.1 Rights from defective performance are governed by the Seller's Complaint Procedure and applicable legal regulations.

8.2 The complaint will be handled no later than 30 days from its assertion.

8.3 The Seller is not responsible for defects caused by improper use, normal wear and tear, or failure to follow the manufacturer's instructions.

8.4 The Seller will issue the buyer with a confirmation stating when the complaint was made, its content, and the method of complaint resolution requested by the buyer.

 

9. Limitation of Liability

9.1 The Seller is not liable for indirect damages, lost profits, or consequential damages arising in connection with the use of the goods, unless otherwise stipulated by law.

 

10. Force Majeure

10.1 The Seller is not liable for non-fulfillment of obligations caused by circumstances of force majeure, particularly interventions by state authorities, carrier failures, technical malfunctions, or third-party interventions.

 

11. E-shop Availability

11.1 The Seller is not responsible for the temporary unavailability of the online store caused by maintenance, technical malfunctions, or unpredictable circumstances.

 

12. Out-of-Court Settlement of Consumer Disputes

12.1 The buyer has the right to out-of-court settlement of a consumer dispute.

12.3 The buyer can also use the online dispute resolution (ODR) platform established by the European Commission.

 

13. Personal Data Protection

13.1 Personal data protection is governed by a separate document "Personal Data Protection Policy (GDPR)".

 

14. Final Provisions

14.1 These GTC are governed by the legal system of the Czech Republic.

14.2 The Seller reserves the right to change or supplement these GTC at any time.

14.3 These GTC become valid and effective on January 6, 2026.
